For those who are wondering why I am posting so much this week, it is because I am away on vacation. I would like to take this opportunity to ask those of you who read my blog to ask questions and suggest future blog posts.
This post is not directly about contractor or homeowner issues, but I have been thinking lately about the stress of dealing with a lawsuit. Parties vary regarding their involvement in their own disputes. Some are happy to hand their claims over to an attorney and check in now and then, and others want to be directly involved and strategize about their claims. However, no matter how much or little involvement you choose, you should realize that lawsuits are extremely emotionally taxing.
First of all, the financial burden cannot be underestimated. Lawsuits are unpredictable. Even if your own attorney is prudent about expenses, he or she has no control about how the other side conducts themselves. Opposing counsel and/or parties can make life miserable and drive up costs. That's just the way it is. Even if you prevail in a lawsuit, there is frequently no guarantee that a judgment will be paid. Different states have different measures available for collection, but it is not usually easy.
Emotionally, lawsuits are difficult. You will be living with your dispute for a long time, and re-living unpleasant experiences every time there is discovery (written questions, document requests and depositions). Your suit will become a part of your life that feels like it never goes away. It is unlikely that a win will be a slam dunk. Ultimately you will probably settle for less than you had hoped for at the beginning.
Why would a lawyer say all of this? The truth is, I am like a surgeon who does not want to do surgery unless it is medically necessary. Most cases settle. Clients have to understand that resolving disputes short of filing suit is usually a better option. Legal expenses have not accumulated extensively, and statistically, parties are much more likely to comply with negotiated settlements. Resolution is not left up to chance where twelve arbitrary jurors are deciding your fate, or a judge is making the decision for you. It is much better to maintain control over your own outcome.
I do not hesitate to advise my clients to file suit when it is necessary and recovering a judgment is feasible. Litigation is my forte along with arbitration and mediation. However, I do not recommend filing suit unless it is worth it, because the emotional and financial consequences are too high.

Unlike doctors, big corporations etc, these guys can hide in the cracks because they are small and it is only one home owner.
It is the feeling of having no power to change the situation that has affected me the most.
I asked the home owner to get the balance down to the contract final payment. He said just finish every thing and I'll pay you in full. I finished the contract and received the C/O. Last week I had to put a lien on his house after months of giving the home owner time to pay. there are also many unetical home owners.
After certain unsuccessful attempts to resolve I am now suing the builder under 93A. I have been told that it will cost me 75k - 90k to actually litigate which is daunting. It makes me wonder what the point of some of these consumer protections laws are. Most people don't have that kind of money.

You never hear how homeowners will hold back payments, or will short a payment all because the homeowner wants extra work they have no intention on paying for.
Homeowners also need to take responsibility for who they hire, if you are only looking at the bottom number and you want the guy who is going to do all your home repairs or remodeling for a fraction of what a good contractor would do it for -- I suggest you look at your self when a job goes bad. You pay for what you get!
You never hear about the Homeowners from hell either -- now the majority of our clients have been absolutely great, but there are a hand full that are horrid.
We recently did a kitchen remodel and the homeowners decided to add, add, add and add, when they were presented with a cost to their changes we were told they could not afford it. So we didn't do the work, but proceeded to finish the contract, then the homeowners at the end of the job, with less then a day of labor to finish, fired us off the job by calling us and telling us to not return!
They now wanted to settle their balance for 1/2 what they owe. We have filed a lien and will follow up with a law suit. Unfortunately, when we declined the offer the homeowner got angry and threatened to tell our clients what a bad contractor we are -- We don't do work for free!
That is a homeowner from hell!
I am cureous how many of the unhappy homeowners used "nontraditional" reference checks on their contractors such as Twitter and Facebook? I think this is a great media to document a grass roots opinion of someone's work and integrity. I have been told "they don't care about this" but I think if United Airlines cares about one piece of lost luggage then a copy of the contract or our polite correstpondece of a request for redo of bad work next to the contractor's decline or no response will one day soon be used by others to make hiriing decisions. We read restaurant reviews. Stay tuned. I perfecting a Facebook page for my contractor with my photographs and copies of emails. I just need to work on the kinks of naming it so that it shows up quickly on a search.

Go to your local circuit court and use their library!!! Study similar cases and use an outline from previous case. If you can find one GREAT. (basically do the lawyers' work). I think these contractors are just angry that they have to competitively price themselves to even be considered when they think they should be making a lot more money. Most people I know are astounded at the cost and hourly rates charged. I don't see where this working group thinks they should be getting paid so much more than the rest of us. A lot of us have skills and don't get paid near as much.
They are also making an assumption that the lowest bidder was even hired. Where do they get that information? Just because you lost a job doesn't mean it was to a lower bidder. People do not always hire the cheapest guy.
Spending more does not always guarantee a better product either. There are plenty of contractors who price jobs above their competencies simply because it's the going rate. Last I was hiring, the line seemed to be "I'm not the lowest ... I'm somewhere in the middle." How the job is priced has nothing to do with the skill level that shows up.
If I were to hire the cheapest guy, I would not expect the best job. A lot of people are probably like that. If I have to pay well, I do expect the job to be done very well in return. There is nothing wrong with that!
If your workmanship is tops, you can sell to the high end market word of mouth and will have no problems. Otherwise, you're not there yet so keep working at it.
Most of the time this people have poor construction skills, make mistakes and leave the job site when they have to fix them! To costly for them!

Lockport contractor Vincent Brege pleaded guilty Thursday to four charges stemming from work he completed on a North Transit Street home last winter.
Appearing city housing court, Brege was fined $1,700, and sentenced to serve 30 Saturdays in the Niagara County Work Program, said Chief Building Inspector Jason Dool. Brege's license to work in the City of Lockport was permanently revoked in May.
Brege pleaded guilty to working without a plumbing license, covering work that should have remained accessible to inspection, having unsafe equipment and fixture closures around a hot water tank, Dool said.
Brege was charged by the city and under the state property maintenance code, Dool said.
Back in February, Brege and his company, Affordable Contractors, were hired to complete work on the bathroom at Gary and Sandy Schuman's North Transit Street home while the couple was in Florida. Brege was initially fined for not having a building permit and working without a license in the City of Lockport. At the time, Brege pleaded guilty and paid the fines.
While Affordable Contractors were hired to completely remodel the Schuman's bathroom, Brege told Dool that they were only replacing a vanity and a glass block window. After the Schuman's received a violation letter for not getting a building permit, they told Dool how much work was really done in the home, leading to further charges against Brege and Affordable Contractors.
According to city records obtained through a Freedom of Information Law request filed in the spring, Brege completed plumbing work in the home without a required master plumber’s license; the plumbing, insulation, framing and electrical work that was done in the bathroom was covered with drywall and was unable to be inspected; the work that was done did not meet the minimum requirements in the Residential Code of New York State pertaining to framing, electrical, plumbing and insulation and the hot water tank was fully enclosed with drywall with no clearance around the tank.
While there are no pending cases against Brege in city housing court, there are pending civil cases, Dool said.
